FATAL DROWNING INCIDENTS IN KENTUCKY

Every year, thousands of people across the United States lose their lives in drowning incidents. Young children are the most common victims of these tragic accidents.

When people lose their lives in drowning accidents, their families may have legal options available to help them move forward.

In order to file a successful lawsuit after losing a loved one, bereaved families must be able to prove that the owner of the property engaged in some form of negligence. This can be showing any of the following exist:

  • The owner of the property failed to install an effective gate on the pool

  • The owner of the pool failed to remove the ladder from the pool

  • There was no fencing around the pool to prevent trespassers from entering

When it comes to children being harmed in drowning incidents, the attractive nuisance doctrine in Kentucky provides that property owners can be held liable for any resulting injuries and damages to young children who enter their property, even if they are not invited guests.

If your loved one has lost their life in a drowning incident, a wrongful death lawyer in Hopkinsville can help you pursue legal action against the negligent party.
